Supervisor Martin explained the duties and responsibilities of the commission and the schedule of meetings they used in determining their recommendation.

Motion by Hayes to accept and approve the two-year salary recommendations of the Local Compensation Commission as presented.

LOCAL OFFICIALS COMPENSATION COMMISSION ORDINANCE

An Ordinance enacted pursuant to Michigan Compiled Law Revised Statutes 41.95(4)-(6) of 1846, as amended, to establish a Local Officials Compensation Commission, establish the composition and appointment of Commission members and establish procedures and policies for said Commission. 

 

THE TOWNSHIP OF WILLIAMSTOWN, INGHAM COUNTY, MICHIGAN ORDAINS:

 

Article I

TITLE

 

This Ordinance is hereby designated as, and shall be referred to as the Local Officials Compensation ordinance.  Within the following text it may be referred to as “this Ordinance”.

 

Article II

CREATION AND APPOINTMENT OF MEMBERS

A local officials compensation commission is created. The commission shall determine the salary of each township elected official. The commission shall consist of 5 members who are registered electors of the township, appointed by the supervisor subject to confirmation by a majority of the members elected and serving on the township board. The terms of office shall be 5 years, except that of the members first appointed, 1 each shall be appointed for terms of 1, 2, 3, 4, and 5 years. The first members shall be appointed within 30 days after the effective date of the ordinance. Subsequent members shall be appointed within 30 days after a term expires or a vacancy occurs. Vacancies shall be filled for the remainder of an unexpired term. An officer or employee of a government agency or unit or member of the immediate family of an officer or employee shall not be appointed to the commission.

Article III

SCOPE OF WORK

The commission shall determine the salary of each member of the township board, which shall be effective at the beginning of the next fiscal year. The determination of the commission shall be the salary unless the township board by resolution adopted by 2/3 of the members elected to and serving on the board rejects the determination. The determination of the commission shall be effective 30 days following filing of the determination with the township clerk unless rejected by the township board. If the determination is rejected, the existing salary shall prevail. The salary of an elected township official shall not be decreased during the official's term of office. An expense allowance or reimbursement paid to elected officials in addition to salary shall be for expenses incurred in the course of township business and accounted for to the township.

Article IV

MEETING SCHEDULE; COMPENSATION OF MEMBERS

The commission shall meet for not more than 15 session days in each odd numbered year and shall make its determination within 45 calendar days of its first meeting. A majority of the members of the commission constitutes a quorum for conducting the business of the commission. The business that the commission may perform shall be conducted at a public meeting of the commission held in compliance with the open meetings act, Act No. 267 of the Public Acts of 1976, being sections 15.261 to 15.275 of the Michigan Compiled Laws. Public notice of the time, date, and place of the meeting shall be given in the manner required by Act No. 267 of the Public Acts of 1976. The commission shall not take action or make a determination without a concurrence of a majority of the members appointed and serving on the commission. The commission shall elect a chairperson from among its members. As used in this section, “session days” means calendar days on which the commission meets and a quorum is present. The members of the commission shall not receive compensation, but shall be entitled to actual and necessary expenses incurred in the performance of official duties.

Article V

 SEVERABILITY, CONFLICTING PROVISIONS, EFFECTIVE DATE

 

Section 5.01.  Severability.  Should any portion of this Ordinance be found invalid for any reason, such a finding shall not be construed as affecting the validity of the remaining portions of the Ordinance, which shall remain in full force and effect.

 

Section 5.02.  Conflicting Provisions Repealed.  All other ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent necessary to give this Ordinance full force and effect.

 

Section 5.03.  Effective Date.  This Ordinance was adopted by the Township Board of the Township of Williamstown, Ingham County, Michigan on the 17th day of October, 2006, and shall take effect on the           day of ___________,2006, thirty (30) days following publication in a newspaper of general circulation within Williamstown Township, in  accordance with Michigan statutes.
